1. Acceptance of Terms and Conditions

These terms and conditions govern your use of the Borrow it Bindaas website (the “Site”), our rental/retail service (the “Service”) and use thereof. If you do not agree with these Term of Conditions you should refrain from browsing or visiting the Site, and using the Service. Your use of the Site  and opting to use the Service, you acknowledge and recognize that you have read, understand, and agree with these Terms and Conditions, becoming a binding agreement between you and the Site. You agree to keep your email address and profile updated at all times, and you will be deemed to have received any communication between the Borrow it Bindaas team and yourself. Whether or not you become a member, by browsing the site you agree to these Terms and Conditions and any changes made to them. The most currently updated version may be viewable on the Site, and may supersede any earlier versions.

2. Changes to Terms and Conditions

Borrow it Bindaas reserves the right to change or terminate conditions of your membership at any time via email. By using the Service after changes have been made you agree to the modifications and terms thereof. You also agree, if you have not opted to terminate your membership, that you accept these changes. If you do not accept, your membership should be terminated within (30) calendar days of such notice, and you are required to return any outstanding items. If you do not agree with any changes, or are unwilling to accept the changes that occur, please notify the team at Borrow it Bindaas that you wish to terminate your account by emailing help@borrowitbindaas.com or calling (888)-993-7623, and also immediately returning all items and discontinuing use of the Site.

3. The Borrow it Bindaas Service

The Service allows registered members to borrow or purchase products from Borrow it Bindaas (“us” “we” “our”) in accordance with the Terms and Conditions by accessing the Site. After selecting desired items, a member may have them shipped to his/her address. This is done with a return-by date. We are a rental service. We reserve the right to limit how many items a member may rent at one time, based on availability or other factors. The currently available options for borrowing are detailed on the Site, as are current shipping policies and rules of return.

Borrow it Bindaas makes no guarantees as to actual delivery time, which may vary based on inventory, your address, the date the order was placed, or other circumstances. Borrow it Bindaas also provides a leeway of 6 to 12 days depending on the delivery address of the member and period of borrowing. As soon as the item is dropped off to the carrier by the Borrow it Bindaas team, the responsibility of said item falls to the borrower. We will notify you via email when your item is shipped. If you return a product in a damaged or dirty condition that exceeds normal wear and tear, as determined by Borrow It Bindaas in its sole discretion, you agree that Borrow It Bindaas may charge your credit card and collect a repair or replacement fee for such product. The product replacement fee varies depending on the specifics of each item and is disclosed to you at the time of borrowing. 

4. Rules of Becoming a Member

To become a member you must be 18 years of age or older. You give us permission to receive information from consumer credit-reporting agencies before you become a member and at any time during your membership. You will automatically be enrolled to renew your membership until you personally terminate it or it is terminated under these Terms and Conditions. When you register, you agree to provide true, accurate, and updated information. If we suspect on reasonable grounds that the information you provided is false or inaccurate, we may suspend or terminate your account and refuse you further Service or use of the Site. You are solely responsible for keeping your password private, and any activity related to your account. To make you account easier to access, we may place a cookie (a small text file) on the computer you are using in order to recognize you.

5. Billing

When you join Borrow it Bindaas, you will be required to provide accurate and complete information about a credit card that you are authorized to use. By signing up for the service, you give permission to Borrow it Bindaas to charge your credit card for all applicable fees for each item, shipping, or any other charges you may incur in use of the Service. If your card expires or the payment is rejected, you agree to make all billed payments upon demand. We may require a second credit card that is valid before we allow you to continue to use our services. We reserve the right to take all necessary steps to collect payment from our members, including but not limited to legal action and the use of third party collection agencies. We also reserve the right to correct any errors on payments being made or incurred. If we feel your credit is not sufficient to cover necessary amounts we may ask that you return all outstanding items and/or provide a second credit card that is valid before continuing to use the Service. We may modify price, content, or nature of service at any time.

 6. Cancellations of the Service: Costs and Refunds

You may return any rented or purchased product for a full or partial refund and/or credit as long as you contact the Borrow it Bindaas team by the provided email address or phone help@borrowitbindaas.com, (888)-993-7623 immediately. If the item is rented and you would like to qualify for a store credit, the item must be undamaged, unworn, and unwashed as determined by Borrow it Bindaas. Keep a copy of your order invoice and securely package the item if borrowed in the provided, pre-paid, pre-addressed envelope for return within 24 hours of receipt of the item. If the item is purchased and you would like to return it for any reason, you must securely package and return it to us within 48 hours of receipt of the item so you are able to qualify for a full refund. If the item is returned to us within 10 days of receipt of your item, you may only qualify for credit, provided that the item is undamaged, unworn, and unwashed as determined by Borrow It Bindaas. We will refund and/or credit the shipping expense you have incurred when sending the item back to us. Please keep a record of the shipping costs incurred, so that we may refund you accordingly. The refund and credit you receive when returning purchased items does not include the original shipping fee and the handling fee. We will notify you within 5-7 business days when your refund and/or credit has been processed.

Any information you submit is subject to our privacy policy, the terms of which are incorporated into these Terms and conditions. Our privacy policy can also be reviewed on the Site.

8. Submissions and Comments

The Site may ask you or other third parties to post comments, give opinions, or rate items. All provided content belongs to the respective authors. We may review and delete any content that is harassing in nature, crass, offensive, illegal, or inappropriate by our standards. We will not be responsible for any loss incurred by you following advice listed by you or third parties on the site. It is up to you to be scrutinizing and see the posts for their true nature. We are free to use any comments or information sent to us through email or on the Site without further compensation, acknowledgement, or payment of any kind. By submitting comments or postings to the site you agree that they are public in nature and use of your words by Borrow it Bindaas does not violate the rights of any third party.

9. Links to Websites

We may provide, or third parties may provide links to other websites that are beyond our control. We are not responsible for the content and make no representations as to the quality, legality, or functionality of such sites.

10. Intellectual Property Rights

BORROW IT BINDAAS is a trademark of Borrow It Bindaas.  "Borrow It Bindaas" and the Borrow It Bindaas logo are registered trademarks of Borrow It Bindaas, under the applicable laws of the United States and/or other countries. All content and compilation thereof on the Site, including but not limited to, text, graphics, logos, designs, photographs, button icons, images and descriptions are property of Borrow It Bindaas, its licensors, and its affiliates and is protected from wrongful copying and dissemination by the United States copyright law, trademark law, international conventions, and other intellectual property law. No material, including, but not limited to the material listed above, should be reproduced or used without our express written permission. The absence of such a logo or signature does not constitute as a waiver of these intellectual property rights. All other products or names visible on the site belong to their respective owners.

11. Taxes

All applicable city, state, and local taxes are your responsibility. You agree to pay those taxes.

 12. Insurance and Accidental Damages

All items borrowed on the Site are subject to mandatory acceptance of the Terms and Conditions and Insurance. This insurance ($5.00 for Sarees and $3.00 for accessories) covers all accidental damage, as solely defined by, determined by, and after being inspected by the Borrow it Bindaas team. This insurance will not cover loss, serious damage, or neglect. We reserve the right to handle each incident on a case by case basis. If there is significant damage that goes beyond wear and tear, your credit card will be charged with the repair charge or full replacement fee that is estimated by us.

13. Indemnity;Waiver

You agree to indemnify, and hold Borrow it Bindaas and all associated members from and against all defilement, losses, damages, and expenses, including reasonable attorney fees, in accordance with violation of these terms and conditions, or any and all wrongful conduct though you or any person using your account on our site.

You hereby waive any damages or claims of any sort, that arise out of your interaction with this website or any associates of Borrow it Bindaas (including management and service providers) from any damages or claims of any sort, arising from your use of this service or of the website.

14. Refund/Credit for Borrowed and Purchased Sarees.

You agree to abide by the rules set forth in the rental agreement, including the notes on purchases for returns and exchanges. Should an item not fit correctly, or be displeasing for any reason, please contact us immediately, so that we may fix the problem.

If the Saree is borrowed and you would like to return it for any reason, you may qualify for an exchange or credit for the borrowing price of your Saree. The Saree must be undamaged, unworn, and unwashed as determined by Borrow it Bindaas. Keep a copy of your order invoice and securely package the Saree, blouses, and petticoat in the provided, pre-paid, pre-addressed envelope for return within 24 hours of receipt of the item. Once we receive the return envelope, we will either send you your exchange or process your credit. This credit you receive when returing your borrowed item does not include the original shipping fee and the handling fee. In order to receive store credit please make sure the return envelope is sent to us within 24 hours of your supposed borrowing start date.

If the Saree is purchased and you would like to return it for any reason, you may qualify for a full refund or credit for the purchase price of your Saree. The Saree must be undamaged, unworn, and unwashed as determined by Borrow it Bindaas. Keep a copy of your order invoice and securely package and send us the items (Saree, blouses, and petticoat) within 48 hours of receipt of the item so you are able to qualify for a full refund. If the item is returned to us within 10 days of receipt of your item, you may only qualify for credit, provided that the item is undamaged, unworn, and unwashed as determined by Borrow It Bindaas. We will refund and/or credit the shipping expense you have incurred when sending the item back to us. Please keep a record of the shipping costs incurred, so that we may refund you accordingly. The refund and credit you receive when returning purchased items does not include the original shipping fee and the handling fee. We will notify you within 5-7 business days when your refund and/or credit has been processed.

 Exclusions:

 Items marked “final sale” are not eligible for return. 

You may not return items 30 days after their delivery.

We do not accept returned items that have been damaged in any way. If you receive an item that has been damaged, please contact us within 24 hours or receipt of your order.

Unfortunately, we do not accept returns on accessories. If an accessory reaches you in a damaged fashion, contact us immediately. 

16. Warranties/Remedies/Disclosures

This limited warranty applies only to you, and may not be sold or transferred. Our warranty does not apply to any matters rising from violation of this agreement.

Remedies: Your sole and exclusive remedy, at our discretion and liability, gives us the option to replace your product so that it may conform, or refund your rental fee (excluding shipping and insurance).

THIS LIMITED WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, HOWEVER IMPLIED OR EXPRESSED, EITHER WRITTEN OR ORALLY, (INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF THE STATE OF THE ABILITY TO BE SOLD, OR THE APPROPRIATENESS FOR A CERTAIN USE OR NON-INFRINGEMENT) WITH RESPECT TO THE PRODUCTS OR RELATED SERVICES.

17. Limitation of Liability

IN NO WAY IS BORROW IT BINDAAS LIABLE TO YOU OR ANY THIRD PARTY FOR DAMAGES OR LOSS INCURRED DURING THE RENTAL OR PURCHASE OF OUR PRODUCTS, WHETHER INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, MULTIPLE OR OTHER UNFORESEEABLE OR FORESEEABLE DAMAGES, INCLUDING LOSS OF PROFITS WHETHER BASED ON WARRANTY, AND EVEN IF BORROW IT BINDAAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ASSUME SOLE RESPONSIBILITY AND RENT OR BUY FROM BORROW IT BINDAAS AT YOUR OWN RISK.

You are responsible for ascertaining the safety of any link that may take you out of our site, and to decide whether or not any information you download is free of malware such as viruses or Trojan horses.

 18. Colors

We do our best to depict our products accurately and in detail, but due to differences in computer display interfaces there is a possibility that any item may appear different in color or style than in actuality.

 19. Copyright Infringement

It is our policy to respect the intellectual property rights of others. We do not promote or condone any infringing activity. If you believe your work has been copied in a way that constitutes copyright infringement, are aware of any infringing material on the Site, or know of someone who is making unauthorized use of the content of the Site, please contact our copyright agent for notice of copyright infringement and notify us of your concern by submitting a written notice to us at the following address: Copyright Agent, 718 Brea Blvd Brea, CA 92821. 

 20. Enforcement of These Terms

We reserve the right to enforce these terms and conditions however we see fit, and to revoke or suspend the membership of any user, which violates these terms. As a user you understand that these terms and conditions are binding, and use of this site is prohibited without acceptance of them in their entirety.

 21. Risk of Loss

Our shipping contract entails that the risk of loss and responsibility of each item falls onto you, the customer, upon delivery from the carrier.

 22. Miscellaneous

This Agreement constitutes the entire agreement between you and Borrow it Bindaas, with respect to the terms hereof, and is the final and complete statement of those terms, superseding all prior oral or written agreements. Modifications may be made by Borrow It Bindaas alone, and we reserve the right to change or terminate this agreement at any time for no reason and without notice. Should we waive a term of this agreement, it does not waive every term of the entire agreement. This agreement shall be governed by and guided by California State law, excluding its conflicts of law principles. You specifically consent to the jurisdiction of the State of California, County of Orange, and agree that all lawsuits, if any, shall only be filed here. You shall not issue this agreement without prior consent of Borrow it Bindaas. Termination of consent will not free you from any binding fees you may owe. Should this agreement be held illegal or unenforceable, the truth of these terms shall remain in full-blown effect. Borrow it Bindaas is not liable for failure to perform any and all of it’s obligations due to unforeseeable factors out of our control, such as disastrous weather, war, acts of terrorism, earthquake, interruptions of supply, fire and the like.
